How much cheaper must a generic be in Switzerland?
Under Art. 65c of the Health Insurance Ordinance a generic's ex-factory price must be below that of the originator. The required gap rises with the originator's market volume: 20 per cent for small turnover, up to 70 per cent for very large. The reference volume is the four years before patent expiry.
What is the differentiated 40 per cent co-payment?
If an insured person chooses the originator although a cheaper generic exists in the same active substance group, the co-payment is 40 instead of 10 per cent (Art. 38a of the Health Care Benefits Ordinance). Exceptions apply where the prescriber documents a medical reason in the individual case.
May a pharmacy dispense a generic without asking?
Yes. Under Art. 52a of the Health Insurance Act pharmacies may substitute a generic unless the prescriber has expressly excluded substitution. The pharmacy must inform the patient and document the pack dispensed.
